Can a tenant dispute a Notice of Eviction?

If a tenant wants to dispute a Notice of Eviction Form 4, the tenant must file an Application by Tenant to Dispute Eviction Form 6 within either 10 or 20 days of receiving the Form 4. The number of days depends upon the reason for eviction.

Is there a grace period for late rent payments?

No. A landlord may serve a tenant with a Notice of Eviction (Form 4) for non-payment of rent the day after rent was due. However, if the tenant pays all of the rent due within ten days, the Form 4 becomes void.

Can a tenant be evicted during the winter months?

Yes. The eviction rules are the same year-round.

What happens to tenant’s security deposit when a landlord sells a rental unit?

The landlord must pass on the security deposit plus accrued interest to the new landlord.

What can a tenant do if a landlord refuses to return a security deposit after the tenant moves out?

If the landlord has not given the tenant a Notice to Keep Security Deposit Form 8 and more than 10 days have passed since the tenant moved out, the tenant may file an Application for an Order Form 2 with the Rental Office asking that the landlord be ordered to return the security deposit.

Can a tenant be evicted for having a pet?

If the rental agreement restricts having pets on the premises, a tenant may be evicted for breaching the rental agreement.

Can a tenant be evicted for smoking on the premises?

If the rental agreement restricts smoking on the premises or in the unit, a tenant may be evicted for breaching the rental agreement.
